CRIME NO.15 OF 2021 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the conditions 6(a) imposed in the order dated 08.07.2021 passed in Crl.O.P.No.11751 of 2021 in so far as directing the petitioner to deposit Rs.10,000/- with the Chief Educational Officer, Vellore.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. J.BHARATHIRAJA, Advocate for the petitioner and of M/S. C.E.PRATAP, Govt. Advocate ( Crl. Side) on behalf of the Respondents the court made the following order:- Pursuant to the orders of this Court, the Director of School Education and Chief Educational Officer(CEO) have appeared before this Court. When this Court questioned about the attitude of the CEO in not accepting the amount and obeying the directions of this Court. The Director of School Education undertook to issue necessary direction to all the Chief Education Officers to receive the amount as per the directions of this Court and carry out the necessary improvement/rehabilitation work in the respective schools. Further, the Chief Educational Officer, Vellore tendered his apology before this Court that hereinafter, he will scrupulously follow the directions of this Court and receive the amount and carry out the necessary improvement works which are needed in the Government Schools.

2. Apart from the above, the Chief Educational Officer, Vellore for non-complying with the directions of this Court, on his own volition, is ready to deposit a sum of Rs.5,000/- for the rehabilitation work of the school. It is made clear that the deposit of Rs.5,000/- by the CEO, shall not be construed to be a punishment against him and would not in any way be treated as disciplinary action against him for the purpose of his future promotional aspects. Necessary proof in regard to payment made thereof by the CEO shall be placed before the Director of School Education and on receipt of the same the Director of School Education shall intimate this Court about the deposit through the Government Advocate (Crl side)

3. However, two weeks time is extended to the petitioner to comply with the condition imposed by this Court with regard to payment and execution of sureties. This modification petition is disposed of accordingly.
