Decree:This Appeal coming on for hearing on this day and upon perusing the Grounds of Appeal , the order of the Lower court and the material papers in the case and upon hearing the arguments of MR.S.Arun Kumar ,Advocate for the Appellant and of Mr.A.A.Venkatesan, Advocate for the Respondents 1 to 4 wherein the 5th Respondent having set Exparte in lower Court itself this court doth order and decree as follows: i)that the compensation award and decree dated 22.01.2019 made in MCOP No.3212 of 2013 on the file of the Motor Accidents Claims Tribunal (Special Sub Court No.1), Chennai be and hereby is confirmed and this Civil Miscellaneous Appeal is dismissed;
ii)that the Appellant herein/Insurance Company/2nd Respondent be and hereby is directed to deposit the award amount together with interest awarded by the Tribunal, less the amount already depostited, if any, within a period of four https://hcservices.ecourts.gov.in/hcservices/
weeks from the date of receipt of a copy of this judgment to the credit of MCOP.NO.3212/2013.
iii)that on such deposit being made, the Tribunal is directed to transfer the shares of respective claimants to their bank accounts through RTGS within one week thereon. iv)that there be no costs in this Civil Miscellaneous Appeal.
