D1/ 16454/ 2014 dated 31.05.2021 in Annexure A items 1 and 2 for S.Nos.55/2 and 55/3 an extent of 1347 sq. meters with interest at the rate of 9% p.a from 2017 onwards.

ORDER
This Writ Petition has been filed seeking a direction to the 1st respondent to disburse the amount of Rs.35,06,548/- equally to the petitioner and the 3rd respondent pursuant to the award made in Award No.3/2021 Na.Ka. D1/ 16454/ 2014 dated 31.05.2021 in Annexure A items 1 and 2 for S.Nos.55/2 and 55/3 an extent of 1347 sq. meters with interest at the rate of 9% p.a from 2017 onwards.
2. Today when this matter is taken up for hearing the learned counsel appearing for the petitioner had sought permission of this Court to withdraw this writ petition. He had also made an endorsement to that effect.
3. The learned counsel appearing for the 3rd respondent would submit that the petitioner claimed to be the adopted son of the 3rd respondent's brother. But however, he is not the adopted son of the 3rd respondent's brother. Further, he would submit that the 3rd is entitled for 50% share in the properties of the petitioner's father and she also filed a suit for partition against the petitioner
before the Subordinate Court, Gudiyattam, in O.S.No.101 of 2013 claiming the aforesaid 50% and the same is pending. Therefore, he prays for dismissal of this Writ Petition.
4. Recording the submission made by the learned counsel for the petitioner and also the endorsement made, this Writ Petition is dismissed as withdrawn. However, since the Civil Suit filed by the 3rd respondent is pending, the 3rd respondent is at liberty to agitate her rights before the Civil Court. No costs.
