ORDER

The present application has been filed to condone the delay of 16 days in filing the written statement in T.O.S.No.72 of 2024.

2. In the affidavit filed in support of the Judge's Summons, it has been stated that the matter had been listed under the caption "For Undefended Board" and thereafter, urgent steps were taken to give instructions to the counsel to prepare the written statement. However, in 1/3

the process, there has been a delay of 16 days. Further, the learned counsel for the respondent/plaintiff had raised a grievance that the parties are Senior Citizen and that process must be speeded up. He also suggests that the matter could be referred to Mediation. But, however, it is only appropriate that the Will is proved in the manner known to law and thereafter, the parties may take a decision to refer the matter to Mediation.
