Respondents Prayer: Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the respondents 2 and 3 to process the petitioner's educational loan application dated 10.07.2014 in respect of three year degree course B.Sc. (Game Design and Game Development) for the academic year 2014-2017 and consequently to remit tuition fee and examination fee to the fourth respondent college for the entire three year course period. ORDER
Heard Mr.D.Anandan, learned counsel for the petitioner and Mr.S.Sethuraman for R2 and R3 and with consent, the writ petition is taken up for final disposal.
2.The petitioner seeks for processing the petitioner's educational loan application dated 10.07.2014 so as to enable the petitioner to pursue his education in B.Sc. (Game Design and Game Development) for the academic year 2014-2017 and consequently to remit tuition fee and examination fee to the fourth respondent college for the entire three year course period. 3.The course is three years programme and the Institution is affiliated to Bharathiar University. The petitioner is said to belong to a backward community and hails from a poor agricultural background. The petitioner has submitted his application from which it is seen that the petitioner has scored 78.2% in X standard examination and 72.3% in XII standard examination.
The petitioner's application for grant of educational loan appears to have been pending and the petitioner's grand father made an enquiry under the RTI and one of the query was whether the petitioner has submitted all the documents required by the Bank. The Information Officer by reply dated 06.01.2015 stated that the petitioner has not submitted all the documents and certain documents are required to be submitted. The petitioner could have very well submitted those document before the third respondent. However, the petitioner appears to have filed an appeal before the second respondent under the RTI. 4.In the light of the above, there will be a direction to the petitioner to produce all the documents sought for by the third respondent and appear in person before the third respondent along with a copy of this order.
On the petitioner furnishing all the documents, the third respondent shall process the application and proceed further and if any clarification is required, the same shall be furnished by the petitioner and the third respondent shall consider the application in accordance with their guidelines, within a period of four weeks from the date on which the petitioner appear before the third respondent in person. The writ petition is disposed of accordingly. Consequently, connected M.P. is closed. No costs.
