The petitioner has filed this writ petition to call for the records concerned relating to the order dated 13.05.2023 issued by the second respondent in Se.Mu.Order No.000704/Nir1/2023 in so far as the petitioner is concerned, transferring the petitioner from Villupuram to Tuticorien and quash the same.
2. When the matter was taken up for hearing, learned Additional Government Pleader appearing for the respondents submitted a written instruction from the Assistant Director (Administration), Commissionerate for Welfare of the Differently Abled, Chennai vide R.O.C.No.000704/Ad.1/2023, dated 09.01.2025. For better appreciation, the relevant paragraph of the written instructions are extracted hereunder: " 3. This Court vide order dated 18.05.2023 refused to grant interim stay to the impugned transfer order. Against this interim order, the petitioner preferred a writ appeal before this Court in W.A.No.1144 of 2023. this Court on 25.05.2023 allowed the prayer of the Page No.2 of 5
petitioner made in the writ petition by setting aside the impugned transfer order.
4. Pursuant to the order of this Court in Writ Appeal, the petitioner is allowed to continue his services in Villupuram district. Since the prayer of the petitioner is already allowed in writ appeal, it is respectfully stated that nothing survives in this writ petition for further adjudication."
3. Since the relief sought by the petitioner has already been granted, this writ petition becomes infructuous and nothing survives for further adjudication.
4. Accordingly, this writ petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petitions are closed. 09.01.2025 (vm) Index :
