PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Certiorari to call for the records pertaining to the cancellation of licence order of the respondent dated 05.10.2013 and quash the same in respect of the shop bearing No.3, Heavy Vehicles Factory Estate, Avadi, Chennai-54.

ORDER

Heard both.

2. This writ petition has been filed by a lessee under the respondent challenging the cancellation of the lease.

3. It is not in dispute that the lease period already expired, that the petitioner also vacated the premises and that the writ petition has become infructuous.

4. The learned counsel for the petitioner submits that at the time of induction of the petitioner, he deposited a sum of Rs.2,09,600/- with the respondent and that the said amount has not yet been refunded to the petitioner. According to the learned counsel, the entire sum has to be refunded to the petitioner.

5. In the light of the said submission, this writ petition is dismissed as having become infructuous with liberty to the petitioner to make a representation to the respondent for return of the advance amount and if any representation is given, the https://hcservices.ecourts.gov.in/hcservices/

respondent shall consider the same and take appropriate action in accordance with law. No costs. Consequently, the connected MP is also dismissed.
