ORDER

The petitioner, who was arrested and remanded to judicial custody on 16.03.2026 for the alleged offences under Section 123 of B.N.S. in Cr. No.119 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 16.03.2026, the petitioner along with other accused, found in possession of 12 nos. of banned narcotic pills. Hence, this case.

3. The learned counsel appearing for the petitioner would submit that the petitioner has been remanded to judicial custody on 16.03.2026 and he is an innocent. The learned counsel would further submit that the petitioner has not at involved in the occurrence as alleged by the prosecution and co-accused were released on bail and hence prayed to enlarge him on bail.

4. However, the learned Government Advocate (Criminal side) appearing for the respondent police would submit that there are three accused and the present petition has been filed by A2 and he has 8 previous cases in his credit and among which, one case is a murder case and hence prays to dismiss the petition.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Though the learned counsel appearing for the petitioner has submitted that the co-accused has been released on bail, even according to the prosecution, the petitioner was charged for the possession of 12 nos. of banned narcotic

tablets and he has been under incarceration since 16.03.2026. However, the learned Government Advocate opposed the bail application on the ground that the petitioner has 8 previous cases in his credit and among which, one case is of murder case. Hence considering the totality of circumstances and taking into consideration of previous bad antecedents of the petitioner, this Court is of the firm view that it is not an appropriate stage to consider the bail application.

7. Accordingly, this Criminal Original Petition is dismissed. 21-04-2026 MJS Note:
