10 R.T.ANANDHAN 11 V.SASIKUMAR Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to extent the time for compliance of the order dated 31.8.2020 of this Honble Court and to act upon the letter dated 4.2.2017 (WMP.17168/2020 in WP.5997/2020) Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.T.M.HARIHARAN, Advocate for the Petitioner and of M/S.JAYESH B. DOLIA, Advocate for the 1 & 2 Respondents the court made the following order:- This writ petition has been filed seeking for extension of time for the compliance of the orders passed by this Court on 31.08.2020.

Mr.Jayesh Dolia, learned counsel appearing on behalf of the respondents 1 and 2 in the writ petition submitted that the earlier contractor did not complete the work and hence, the contract was terminated and it has now been entrusted to the new contractor who commenced the work from January 2020 onwards. The learned counsel further submitted that due to the Pandemic situation, the work was stalled and it was again started only recently. The learned counsel therefore submitted that some more time can be granted by this Court to comply with the earlier orders passed by this Court and report compliance.

Mr.T.M.Hariharan, learned counsel appearing on behalf of the petitioner submitted that the respondents 1 and 2 have been taking a very long time and a promise that was given in the year 2017 is yet to be fulfilled and the respondents 1 and 2 have again filed an application seeking for extension of time. Even though, the learned counsel vehemently opposed the grant of any extension of time to the respondents 1 and 2, submitted that this Court can pass suitable orders to ensure that the petitioner gets the passage for access from Thiruvottiyur High Road at the earliest. The learned counsel further submitted that this writ petition can be kept pending and the respondents 1 and 2 can be directed to report compliance of the earlier orders passed by this Court.

Taking into consideration the facts and circumstances of the case and also after carefully considering the submissions made on either side, the time granted by this Court for reporting compliance is extended up to 26.02.2021. It is made clear that no further extension of time will be granted by this Court and the respondents 1 and 2 will have to necessarily report compliance during the next date of hearing. This writ miscellaneous petition
is disposed of accordingly.
