... Respondents / Respondents This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Ms.M.Malar, learned counsel for the Appellants/claimants and Mr.D.Baskaran, learned counsel for the 2nd
respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.18,04,000/- [Rupees Eighteen Lakhs Four Thousand Only], together with interest at 7.5% per annum, from the date of petition i.e. 14.07.2021 till the date of payment with cost. Aggrieved by the award of the Tribunal, the appellant/claimant preferred the present appeal.
2. After due deliberation and consultation, both the parties have agreed to settle the award to a sum of Rs.3,00,000/- (Rupees Three Lakhs Only), over and above the award amount of the Tribunal, as full quit compensation.
3. The second respondent/ insurance company is directed to deposit the amount of Rs.3,00,000/- (Rupees Three Lakhs Only), now arrived today, within a period of six weeks from the date of receipt of a copy of this order, to the credit of M.A.C.T.O.P.No.2830 of 2021 on the file of the Motor Accident Claims Tribunal, (Special Sub Court No.1, Motor Accident Claims Petitions), Small Causes Court, Chennai and on such deposit, the appellants/claimants are directed to withdraw the same, as apportioned by the Tribunal.
4. The Tribunal is directed to transfer the amount through RTGS/NEFT to the party concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly.
