This Civil Miscellaneous Petition has been filed seeking to condone the delay of 273 days in re-presenting the above Civil Miscellaneous Appeal.

2. The learned counsel appearing for petitioner submitted that the judgment was delivered on 27.08.2019 and the appellant has also filed the appeal in time. However, it is submitted that the papers were returned by the Registry for certain compliance, for want of certain documents, the appellant was not in a position to represent in time. Hence, the delay.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay in re-presenting the appeal is condoned and the petition is ordered. Registry is directed to number the appeal, if the papers are otherwise in order and post the matter for admission on 16.10.2020.
