(Order of the Court was made by M.M.SUNDRESH,J.) When the civil miscellaneous petition is taken up for hearing, the learned counsel for the appellant/petitioner submitted that the appeal may be dismissed on the ground of low tax effect.

2. Considering the same, without standing on the technicalities, we are inclined to condone the delay of 980 days which is occasioned in representing the papers. Accordingly, the delay is condoned and the civil miscellaneous petition stands allowed.
