ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence u/s 294 B, 417, 376, 506(1) IPC in Crime No.17 of 2020, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the the petitioner induced the defacto complainant and had sexual intercourse with her on the false promise of marriage due to which, she had become pregnant. Thereafter, petitioner refused to marry the defacto complainant. Hence, the defacto complainant made a complaint against the petitioner.
3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.
4.The learned Government Advocate (Crl. Side) would submit that this is the second anticipatory bail application filed by the petitioner and this Court has already dismissed the earlier https://hcservices.ecourts.gov.in/hcservices/
anticipatory bail application of the petitioner. He further submits that the Statement of the victim girl was recorded under Section 164 Cr.P.C and also submits that the investigation is still pending. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5.Considering the gravity of offence and the earlier anticipatory bail petition was dismissed by this Court considering the statement of the victim girl recorded under Section 164 Cr.P.C in which the victim girl imputed serious allegations against the petitioner and there being no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. -sd/- 08/09/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
