This Arbitration Original Petition has been filed under Section 11(6)(b) of the Arbitration and Conciliation Act, 1996 to appoint a Presiding / Third Arbitrator to the Arbitral Tribunal, to adjudicate upon the disputes between the petitioner and the respondent in connection with Tender No.CO CONTS/0030 C/NTPL/TTPP/CISF Quarters/2015, dated 08.05.2015 and the consequential Letter of Award bearing No.CO CONTS/0030 C/NTPL/TTPP/CIS Quarters/2015 dated 05.03.2016 and the consequential Agreement No.053565/CO CONTS/0030 C/NTPL/TTPP/CISF Quarters/2015.
2. Heard Ms.Shanthini, learned counsel for the petitioner.
3. From a reading of the agreement dated 08.05.2015 entered into between the petitioner and the respondent, it could be seen that the parties have agreed to resolve the disputes by appointing an Arbitrator.
4. The learned counsel for the respondent submits that the respondent's nominee Arbitrator has since passed away. In view of the same, the learned counsel for the respondent suggests that a Sole Arbitrator may be appointed by this Court to adjudicate the disputes between the parties, to which the learned counsel for the petitioner has no serious objection.

In view of the arbitration clause contained in the agreement and considering the nature of claim and also the considering the submissions made on either side, this Court deems it appropriate to appoint an Arbitrator. Accordingly, Mr.Srinath Sridevan, Senior Advocate, (Mobile No.98410 49950) residing at Access House, 2nd Floor, No.24 Judge Jambulingam Street, Mylapore, Chennai - 600 004 is appointed as Sole Arbitrator to enter upon the reference and resolve the disputes between the petitioner and the respondent. 6.
The learned Sole Arbitrator is entitled to fix his fees as per the Schedule-IV of the Act. This Court further requests the learned Sole Arbitrator to endeavour to decide the dispute as expeditiously as possible.
