Seeking leave to sue as against the second defendant, the applicants/plaintiffs has come up with this Application. 2.The Applicants/Plaintiffs has filed a suit to declare that the settlement deed dated 21.04.2014, registered as Document No.1498 of 2014 in the office of the Sub Registrar, Mylapore, executed by the first defendant in favour of the second defendant, relating to the suit property, as null and void and not binding on the plaintiffs and other consequential reliefs.

3.Based upon the averments made in the plaint, learned counsel for the applicants submitted that the entire cause of action had arisen within the territorial jurisdiction of this Court. The second defendant is living outside the jurisdiction of this Court.

4.Considering the submission made by the learned counsel for the applicants and considering the averments made in the plaint, leave is granted.
