C.M.P.Nos. 10078, 10080 & 10077 of 2022 in S.A. No. 256 of 2013 T.V. THAMILSELVI, J.

These petitions are filed seeking to condone the delay of 248 days in filing the petition for setting aside the abatement, to set aside the abatement caused due to the death of appellant, and to bring on record the proposed appellants 1 to 4 herein as legal representatives of deceased appellant.

2. Mr.T.Saikrishnan, learned counsel for petitioner/appellant submitted that pending appeal, sole appellant died on 19.05.2021. Hence, he has filed the above petitions.

3. Mr.A.Arunbabu, learned counsel appearing for the respondent appeared and raised his objections.

4. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit, all the petitions are allowed. The proposed legal representatives of the appellant are impleaded as appellants 1 to 4 in the above Second Appeal.
