C.M.P. No. 10080 of 2016 in S.A.No.1925 of 2004 T.V. THAMILSELVI, J.

This petition has been filed seeking to implead the petitioners/proposed parties as respondents 18 & 19 in this appeal.

2. The learned counsel for the petitioners submit that the petitioners purchased the portion of the property during the pendency of the appeal and the same was observed by the first appellate Court in its order.

3. The learned counsel for the respondent raised objection to implead the petitioners.

4. Considering the facts of the case, the first appellate Court also observed in the order that the portion of the property was sold under equity. Hence, as a purchaser the petitioners herein are entitled to get the property and in order to avoid multiplicity of proceedings, this Court is inclined to allow this petition. Accordingly, this petition is allowed.

5. Post the appeal on 17.12.2024.
