C. Vellingiri v. R. Anuradha
C.M.P.No.10928 of 2022 in S.A.No.222 of 2018 P.T.ASHA, J., The above petition is filed seeking return of the Sale Deed dated 28.10.2010 marked as Ex.A1 in the suit O.S.No.46 of 2011 on the file of the District Munsif cum Judicial Magistrate Court, Pochampalli.
2. Heard Mr.T.M.Hariharan, learned counsel for the petitioners/appellants and Mr.V.Nicholas, learned counsel for respondent3/Caveator.
3. The petitioners have substituted the certified copy of the said Sale Deed along with the petition. In the affidavit filed in support of this petition, the petitioners have given an undertaking that they will not alienate or encumber the suit property in Survey No.10/1.
4. Recording the above undertaking and taking note of the fact that the respondent-3 does not have any objection for return of the document, this petition is ordered as prayed for and the certified copy that has been filed along with the petition shall be substituted in the place of the original Sale Deed-Ex.A1. The original Sale Deed-Ex.A1 shall be returned to the petitioners/appellants after getting necessary endorsement.
