This petition has been filed to direct the respondent police to take action based on the complaint of the petitioner dated 28.07.2016 and to register FIR and investigate the same.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.
3. It is represented by the learned Additional Public Prosecutor that on the complaint given by the opposite party, petition enquiry is pending in CSR No.136 of 2016. Similarly, on the counter complaint given by the petitioner, petition enquiry is pending in CSR No.137 of 2016 4.
Recording the submission of the learned Additional Public Prosecutor, the respondent police are directed to enquire into both the complaints and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, in accordance with the law laid down by https://hcservices.ecourts.gov.in/hcservices/
the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [(2014) 4 SCC 1], otherwise, the petition may be closed under intimation to the petitioner and the opposite party. This Criminal Original Petition is disposed of with the above direction.
