Though the learned counsel for the respondent is ready, there is no representation for the appellant. Even in the previous hearing on 26.04.2016, there was no representation for the appellant. Hence, the matter was ordered to be posted under the caption for dismissal today, i.e, on 28.04.2016. Even today, there is no representation for the appellant. Hence, this Court is of the view that the appellant is not interested in prosecuting the appeal.

In view of the above, this Civil Miscellaneous Appeal is dismissed for default. No order as to costs.
