The petitioner seeks anticipatory bail in Crime No.21 of 2023, registered by the respondent under Sections 406, 420 and 120B IPC. 2.The petitioner is the 1st accused. The 3rd and 4th accused are the sons of the petitioner. The 2nd accused had been taken into custody and he is still in custody. All the accused persons had brought about a novel scheme, wherein they had proposed to sell plots of land on payment of sale consideration on instalment basis but they have neither sold any land but they have received sale consideration of Rs.1,52,00,000/- from 152 persons and they have not even returned back the sale consideration. My learned predecessor by an order dated 13.9.2023 gave a ray of hope to the petitioner by directing the petitioner to come forward to deposit some amount. The learned counsel states that he would deposit a sum of Rs.

60,00,000/- which is far for less than the amount gained by them. The entire modus operandi will have to be examined. The plight of 152 persons, who had parted with valuable money will have to be kept in mind. The fact that not even one single plot of land had been sold will also had been taken into consideration. kp 3.In view of that particular view, the criminal original petition stands dismissed. The petition has been pending from 15.5.2023. The respondent is directed to take appropriate action as against the petitioner and also against the other accused.
