O R D E R

(This case has been heard through video conference) The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 341, 294(b), 323, 324, 307 and 506(ii) of I.P.C in Crime No.866 of 2020, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution as per the defacto complainant is that on 02.08.2020 the petitioner along with his friends waylaid the defacto complainant and assaulted the petitioner with knife and wooden logs and also threatened with dire consequences. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is a innocent and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit the petitioner is a notorious element and member of a gang in the area. He would further submit that the petitioner along with other accused persons way laid the defacto complainant and assaulted with knife. He would also submit that the petitioner has one previous case U/s 307 of I.P.C. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner.

5.Taking into consideration of the facts and circumstances of the case and the above submission so made by the Additional Public Prosecutor and the petitioner has got one previous case to his credit, this Court is not inclined to grant bail to the petitioner.
