India, praying to set aside the Order and decreetal order passed in transfer OP.No.87 of 2018 dated 05.01.2019 by the Principal Sessions Judge, City Civil Court, Chennai, dismissing the said petition filed by the petitioner herein under Section 24 of CPC and pass an order for withdrawal and transfer of O.S.No.4260 of 2014 from the file of the learned XIV Assistant Judge, City Civil Court, Chennai to the file of the learned XIX Additional Judge, City Civil Court, Chennai to be disposed simultaneously with OS.No.6687 of 2014 or vice versa.

O R D E R

When the matter was taken up for hearing, the learned counsel appearing for the petitioner filed a memo stating that the Civil Revision Petition has been filed challenging the dismissal of the transfer application filed by the petitioner for transfer of O.S.No.4260 of 2014 from the file of XIV Assistant Judge, City Civil Court, Chennai to the file of the learned XIX Additional Judge, City Civil Court, Chennai, for disposal simultaneously with O.S.No.6687 of 2014. However, O.S.No.6687 of 2014 was dismissed for 2/4

default on 31.03.2022. In view of the same, the prayer regarding transfer has become infructuous.

2. The learned counsel further submits that the Civil Revision Petition may be closed with liberty to revive the same, in case the suit in O.S.No.6687 of 2014 is restored to the file.

Recording the memo dated 06.02.2014 filed by the petitioner and the submission made by him, this Civil Revision Petition is closed with liberty to revive the same, in case the suit is restored to the file.
