Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondents to consider the petitioner's representation dated 6.8.2015 requesting for payment of salary to the Road Inspectors through Electronic Clearance System as directed in G.O.Ms.No.62, Finance Department dated 12.03.2012. ORDER
By consent, the writ petition is taken up for final disposal.
The petitioner/Association would state that in terms of G.O.Ms.No.62, Finance [Letter of Credit] Department dated 12.03.2012, orders have been issued directing that the salary and other establishment related payments, in respect of the Public Works Department, Forest Department and Highways Department, is to be drawn only by Bills through Treasuries under existing Electronic Clearance System with effect from 01.04.2012 and the grievance expressed by the petitioner/Association is that though the said Government Order is in vogue from 12.03.2012 onwards, still the salaries are disbursed through cheques issued in the name of the Assistant Engineers, who, in turn, encash the cheques and then make payment to the Road Inspector and it further leads to belated disbursement of salary etc., and in this regard, a representation dated 06.08.2015 has been submitted to the respondents 1 and 2 and the grievance expressed by the petitioner/Association is yet to be addressed, the petitioner/Association came forward to file this writ petition.
Heard the learned counsel for the petitioner and Mr.V.Subbiah, learned Special Government Pleader, who accepts notice on behalf of the respondents.
This Court, taking into consideration the limited scope of prayer sought for by the petitioner, directs the respondents 1 and 2 to consider and dispose of the petitioner's representation dated 06.08.2015 on merits and in accordance with law, after taking note of the above cited Government Order and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner. The writ petition is disposed of accordingly. No costs.
