ORDER
Mr.M.Shahjahan, learned Special Government Pleader takes notice on behalf of the first respondent and Ms.N.Senthil Selvi, learned Government Advocate takes notice on behalf of the second and third respondents.
2. Heard both sides. I have perused the affidavit filed in support of the present writ petition.
3. The case of the petitioner appears to be that the third respondent has collected amount above Rs.1,000/- from each of the residents for construction of nine upper water tanks to get water from Kollidam and Keezhvellur Lake, which is contrary to the resolution of the Panchayat Board.
4. It is the allegation that the third respondent has collected amounts in excess and has pocketed the same. It is submitted that despite the circular dated 10.07.2020, bearing Ref.No.1909/2020/A3 issued to all the Panchayat Presidents of Keezhvellur locality by the second respondent to regularize the unauthorized usage of water pipelines, no steps have been taken. Considering the fact that the matter has been referred to the first respondent the District Collector, Nagapattinam District, I am inclined to dispose this writ petition at the time of admission, without expressing any opinion on merits of the case, by dispensing with filing of counter, by directing the first respondent to consider the petitioner representations dated 23.09.2020 and 21.12.2020 and dispose the same, within a period of thirty days from the date of receipt of a copy of this order.
6. Needless to state, before passing such order, the petitioner as well as the third respondent shall be heard.
7. This Writ Petition stands disposed of with the above observations. No costs.
