2. The case of the prosecution is that when the petitioner/accused was taken to the scene of occurrence by the respondent in respect of Crime No.47 of 2025, the petitioner had abused the respondent and other police personnel in filthy language and attempted to assault them with a knife, in which, the Grade-I constable sustained injury. Hence the case.
3. The contention of the learned counsel appearing for the petitioner is that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that even on earlier occasions, same representation was made by the prosecution, thereby, the matter was adjourned twice. He further submitted that the petitioner is in judicial custody from 20.03.2025 and he is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. Learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and opposed for granting bail to the petitioner stating that the proposal for detaining the petitioner under Act 14 is pending. He further submitted that there is no previous case against the petitioner.
5. Heard both sides and perused the materials available on record.
6. Considering the facts and circumstances of the case, the submission made by the learned counsel appearing on either side and taking note of the fact 2/4
that the petitioner was arrested on 20.03.2025 and the proposal for detaining the petitioner under Act 14 is pending for almost two months, this Court is of the opinion that there is no proximity to detain the petitioner under Act 14. Thereby, this Court is inclined to grant bail to the petitioner with certain conditions.
7. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.1, Chidambaram, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019'].
