[Order of the Court was made by M.SUNDAR, J.,] This order will now dispose of the captioned 'Habeas Corpus Petition' ['HCP' for the sake of brevity].
2.Captioned HCP was filed in this Court on 16.05.2023. 3.Factual matrix in a nutshell is that the petitioner's 27 years old son 'Mr.Manavalan' [hereinafter 'absentee' for the sake of convenience] is missing; a complaint has been lodged with the jurisdictional police i.e., C-2 Race Course Police Station, Coimbatore and the same has been taken on file vide Crime No.215 of 2023 (Man missing). 4.Today, the petitioner, petitioner's counsel Mr.E.Suganthan, Mr.E.Raj Thilak, learned Additional Public Prosecutor for both respondents and the absentee are before this Court.
5.This bench is informed that the absentee is clearly a major 2/4
has stated that he was not in illegal detention, he left home on his own volition, he has now come back and he would go back home with his father (HCP petitioner).
6.In the light of the aforementioned position, we drop the curtains on the captioned HCP.
7.Captioned HCP is disposed of as closed recording the aforementioned scenario which unfed in the hearing today and the stated position of the petitioner and absentee. There shall be no order as to costs. (M.S.,J.) (R.S.V.,J.) 10.07.2023 TK 3/4
