O R D E R

The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondents to grant family pension with selection grade in the post held by petitioner's father in the respondent office by counting his entire service as Supervisor with all revisions attendant service benefits including all arrears payable from 18.09.1980 to 27.07.2005 to petitioner within the time period stipulated by this Court.

It is the contention of the learned counsel for the petitioner that the petitioner's father worked as Union Overseer in the 2nd respondent office and he died on 27.07.2005 after having rendered the service of 24 years,10 months and 10 days. He further submitted that though the petitioner's father imposed with several punishments, he rendered service till 27.07.2005, but his pay was not regularized. In this connection, the petitioner had sent a representation on 07.07.2020, but the same was not considered till date. 3.The learned Government Advocate would submit that, in view of the 2/5

punishment imposed and the effect of excessive medical leave, the regularisation of the petitioner's service could not be done in accordance with the law. The learned Government Advocate would further submit that the petitioner's representation dated 07.07.2020 has not yet been considered by the respondents. If any further representation is received from the petitioner, the same will be considered and disposed of by the respondents within a reasonable time as fixed by this Court.

4. Heard the learned counsel for both sides and perused the materials available on record.

Though there are disputed facts between the parties, taking into consideration the fact that the representation made by the petitioner is yet to be considered, this Court without going into merits of the matter, deems it appropriate to direct the respondents to consider the representation of the petitioner and pass orders on its own merits and in accordance with law. The said exercise shall be done within a period of twelve weeks from the date of receipt of a copy of this order.

6. In the result, this Writ Petition is disposed of with the above 3/5

observations. No costs.
