O R D E R

The instant writ petition has been filed seeking the relief of writ of Mandamus, directing the respondents to grant first increment with all consequential benefits from 07.04.2022 the date on which I have completed the punishment period and to pay arrears of wages along with 12 percentage interest from the date of dues to till the date of realization of the amount.

2. Heard Mr.R.Jai Kumar, learned counsel for the petitioner and Mr.K.Raja, learned Standing Counsel for Transport Corporation appearing on behalf of the respondents 1 to 3.

3. It is the submission of the petitioner that he was appointed as Reserve Driver on 08.04.2013 and subsequently, confirmed only on 31.10.2020 with a basic pay fixed as Rs.17,500/- per month. In the meanwhile, due to some delinquency, the respondent has imposed punishment and all the punishment period was completed on 06.04.2022 and thereafter, the petitioner was given first increment on 07.04.2022, which according to the petitioner is in contravention to the Service Rules. Hence, he has sent the representation on 26.01.2024 and the same has not been considered by the respondents till now. 2/4

4. Mr.K.Raja, learned Standing counsel for the respondents would fairly submit that they will consider the petitioner's representation within a reasonable time.

5. In view of the above submission made by the learned Standing counsel, this Court, without going into the merits of the matter, directs the respondents to consider the petitioner's representation dated 26.01.2024 and pass orders on it's own merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.
