ORDER

The petitioner apprehends arrest for the alleged offence under Sections 126(2), 296(b), 115(2), 118(1), 351(3) of BNS, 2023 in Crime No.152 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that, due to trivial issues, a wordy quarrel arose between the petitioner and the defacto complainant, during which the petitioner assaulted the defacto complainant, thereby causing injuries. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that the defacto complainant sustained serious injuries and was discharged from the hospital only after a period of 20 days. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the above aspects, the nature and gravity of the injuries sustained by the defacto complainant, this Court is not inclined to enlarge the petitioner, as the same may embolden him to commit similar offences and would send a wrong signal to the society.
