ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Section 77D,6,24(I) of Tobacco Act of I.P.C. in Crime No.522 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is the lorry driver. Based on the compliant given by the defacto complainant, the respondent police seized the petitioner's vehicle, while carrying tobacco products in the said vehicle.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offences as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that the petitioner did not aware that the bags are tobacco products in the said vehicle. Hence, the learned counsel prays for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl. Side) submitted that the petitioner and other accused were illegally transported the https://hcservices.ecourts.gov.in/hcservices/

tobacco products worth about more than Rs.1 Crore. Hence, he vehemently opposed the grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and the gravity of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
