Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents 1 and 2 to conduct an enquiry against respondents 4, 7 and 8 as they have not properly appreciated/alerted the second respondent/District Collector about the pendency of disciplinary proceedings under the Tamil Nadu Village Panchayat Secretaries (Conditions of Service) Rules 2013 against the 10th respondent/Panchayat Secretary for causing a loss of Rs.22,78,186/- (Rupees Twenty Two Lakhs Seventy Eight Thousand One Hundred Eighty Six Only) to the 9th 2/5

respondent/Kanakkampalayam Village Panchayat in Special Audit Report dated 18.08.2020, as otherwise the 2nd respondent who originally suspended the 10th respondent by his proceedings Na.Ka.No.2161/2020/Aa1 dated 28.08.2020 had revoked the suspension of the 10th respondent within 18 days and posted her in the Kosavampalayam Village Panchayat, Gudimangalam Block, Tiruppur District by his proceedings in Na.Ka.No.3551/2020/V6 dated 15.09.2020 and thereafter once again would not have transferred within 94 days the 10th respondent back to the 9th Respondent/Kanakkampalayam Village Panchayat by his proceedings in Na.Ka.No.4552/2020/V6 dated 30.11.2020 and consequently re-transfer the 10th Respondent to a non-sensitive post till the disposal of the disciplinary proceedings against her and pass orders.
