..Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 2nd respondent to allow the petitioner to continue his course in B.E.(Electrical and Electronics Engineering) so as to enable the petitioner to get the degree.

The petitioner had joined B.E., (E.E) decree Course in 2008-09. After completion of six semesters, the petitioner was not permitted to write the examination since he lacked attendance. His application for condonation of attendance for continuing his course was also rejected. The petitioner had earlier challenged the rejection order in W.P.No.15358 of 2011 and W.A.No.806 of 2012, which went against him.

2. In this circumstances, the petitioner had given a representation to the 2nd respondent on 09.03.2013 with a request to permit him to redo the sixth semester once again. Since the representation has been kept pending by the 2nd respondent till date, the petitioner had filed present writ petition.

3. Heard Mr.P.Ganesan, learned counsel for the petitioner and Mr.L.P.Shanmugasundaram, (Special Govt. Pleader) learned counsel for the 1st respondent and Mr.V.Ayyadurai learned counsel for the 2nd respondent.

4. The learned counsel appearing for the petitioner would submit that apart from his request for re-doing the semester, he had also made request to the second respondent seeking for his transfer to some other college in the first respondent college/University. The learned counsel would also submit that if a direction is given to the respondent to consider the representation of the petitioner, he would be satisfied.

5. In the light of the above submissions made, the petitioner is directed to give a fresh representation to the 2nd respondent setting forth his request with regard to the re-doing the semester and transfer to other college under the 1st respondent and on receipt of such representation, the 2nd respondent shall pass orders on its own merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.

6. With the above observation, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
