ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2) & 326(a) of BNS in Crime No.29 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner along with other accused was illegally transported two units of sand with the help of lorry and JCB without any valid permission. On seeing the de facto complainant, the petitioner escaped from the scene of occurrence. Hence, the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case by the respondent police and prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that there are five previous cases similar in nature pending against the petitioner. opposed the grant of anticipatory bail to the petitioner.

5. In such view of the matter, the petitioner has five previous cases of the same nature, which clearly demonstrates that the petitioner has misused the liberty granted by this Court. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
