Meenashi (Died) v. Vennilla
C.M.P.Nos.1382, 1383 and 1384 of 2018 in S.A.No.580 of 2017 P.T.ASHA, J., These petitions have been filed by the petitioners to condone the delay of 1052 days in filing the application to set aside the abatement caused due to the death of the sole appellant and to bring on record the legal representatives of the deceased sole appellant as party to the second appeal.
2. Heard the learned counsels on both sides.
3. The learned counsel for the respondents 1 and 2 would submit that she has no objection for these petitions being ordered.
4. Considering the submissions made on either side and being satisfied with the reasons stated in the affidavit filed in support of these petitions, the delay is condoned and the petitions are allowed. The Registry is directed to carry out the necessary amendments.
5. In the meanwhile, the 4th respondent is reported dead and therefore, the proposed appellants are directed to take steps to bring on record his legal representative by 09.01.2023. 29.11.2022 ssn https://www.mhc.tn.gov.in/judis
