Respondents Prayer : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to appoint the petitioner as Lab Assistant in any of the school education department within the jurisdiction of 3rd respondent by considering the petitioner's representation dated 02.05.2017 on the light of the interview calling letter sent by the 3rd respondent to the petitioner.

O R D E R

The relief sought for in this writ petition is for a direction to appoint the writ petitioner in the post of Lab Assistant in any one of the schools in the Education Department within Thiruvannamalai District.

2. The prayer itself is misconceived since the appointment can never be claimed as a matter of right. The writ petitioner though participated in the written examination and also in certificate verification, he has to wait for the decision with regard to the publication of final list of selected candidates. Even before the receipt of such a publication from the respondents, the present writ petition is filed hurriedly. Thus, this court is of the view that the writ petition is premature and the writ petitioner is not an aggrieved person as on today i.e. 19.07.2017, in view of the fact that no final list of selected candidates were published.

3. The learned Additional Government Pleader appearing on behalf of the respondents submits that, if the petitioner is fully qualified and eligible for appointment, her case will be considered along with other candidates, who had participated in the recruitment process. Thus, no further adjudication is required.

4. Accordingly the writ petition stands dismissed. However, there is no order as to costs. Consequently, connected miscellaneous petition is closed.
