Respondent PRAYER : Criminal Original Petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, Act, 2023, praying to enlarge the petitioners on anticipatory bail in the event of their arrest in Crime No.5 of 2024 pending investigation on the file of the respondent police. 1/4

For Petitioners : Mr.D.Shivakumaran For Respondent : Mr.N.Palanivel, Government Advocate (Crl.Side)

ORDER

The petitioners apprehend arrest for the alleged offences under Sections 406, 465, 467, 468, 471, 420 and 506(1) of IPC, in Crime No.5 of 2024 on the file of the respondent police seeks anticipatory bail.

2. The learned counsel for the petitioners would submit that this Court had granted interim anticipatory bail by order dated 05.06.2024 in Crl.O.P.Nos.12867 and 12697 of 2024, wherein Condition No.10(a) reads as follows:

(a) the 1st petitioner / R.Munirathinam is directed to deposit a sum of Rs.2,00,00,000/- (Rupees Two Crores only) to the credit of Crime No.5 of 2024 before the concerned Magistrate within a period of six weeks from today and shall produce the said receipt before the Court below, failing which, the interim anticipatory will be cancelled.

3. The learned counsel would further submit that, in the present case, these petitioners have been arrayed as A2 to A4 and A6 to A15. When A1 / R.Munirathinam challenged the condition imposed in paragraph 10(a) of the order dated 05.06.2024 before the Hon'ble Supreme Court, the same came to 2/4

be dismissed. Pursuant thereto, the said condition has been complied with by depositing a sum of Rs.2 crores before the concerned Magistrate, which fact has also been admitted by the learned counsel for the intervenor.

4. But the learned Government Advocate (Crl.Side) appearing for the respondent police was not in a position to confirm the same. However, it is seen that the petitioners were granted interim anticipatory bail on 05.06.2024 and it is also an admitted fact that the final report has been filed and taken on file in C.C.No.733 of 2026.

5. Taking into consideration of the totality of the circumstances, this Court is of the view that at this length of time no custodial interrogation is required.

6. In such view of the matter, the interim anticipatory bail granted to the petitioners by this Court in Crl.O.P.Nos.12867 & 12697 of 2024 dated 05.06.2024, is made absolute on the same terms and conditions. 09.06.2026 cda 3/4
