consequently direct the respondents to revise the average emoluments as Rs.23,100 + grade pay of Rs.4800/- instead of Rs.22,280/- + Grade of pay of Rs.4800/- and to further re-fix the pension and other retirement benefits effective from 01.07.2013 with all the monetary benefits arising thereto. ORDER
(Order of the Court was made by K.Kumaresh Babu J.) The petitioner's claim for grant of increment, which is governed by the judgment of the Hon'ble Apex Court in Civil Appeal No.2471 of 2023 and followed in Civil Appeal No.3933 of 2023, had been negatived, on the ground of res-judicata, as the petitioner had already approached the Tribunal and lost the claim.
2.However, today, when the matter was taken up for hearing, the learned Senior Panel Counsel for the respondents, placing reliance on the counter affidavit filed by the respondents, would indicate that the petitioner had been benefitted one notional increment from 01.05.2023 prospectively, pursuant to the orders of the Hon'ble Apex Court. However, his claim from the year 2013 to 2023 stood negatived. The said factum had not been placed before the Tribunal, while dealing with the matter.
3.In view of the statement made in the counter affidavit that the petitioner had benefitted with his claim, but however, only with prospective effect, we do not find any necessity to adjudicate the writ petition any further and accordingly, the writ petition stands closed.
