W.P.No.14980 of 2025 has been filed, challenging the selection list dated 07.03.2025 issued by the 2nd respondent Recruitment Cell in respect of provisionally shortlisted candidates for the post of Examiners, Reader, Senior Bailiff and Junio Bailiff in Villupuram District.
2. The core contention made on behalf of the petitioner is that over-qualified persons are appointed to Class-IV Category, thereby depriving the right of opportunity to rightfully qualified persons. Candidates possessing SSLC and Higher Secondary qualifications were deprived of their opportunity to secure employment. These qualified candidates cannot be equated with higher qualified candidates. Even in the selection process, there is no level playing field. Thus, the Selection List is to be quashed and set aside.

No doubt, anguish and views expressed by Mr.V.Govardhanan, learned counsel for the petitioner has got relevance and significance in the matter of providing equal opportunity in public employment as mandated in the Constitution of India. Prescription of minimum and maximum qualifications are essential for the purpose of maintaining level playing field amongst equally qualified candidates. Based on the judgment of this Court, High Court Rule was implemented subsequently and maximum qualification is also prescribed. However, in respect of selection process already conducted, the same cannot be unsettled, since selection process was conducted as per Rules, which was in force during the relevant point of time. That apart, process of selection was already concluded and selected candidates are serving in the Judicial Department. That being so, relief sought for at this juncture cannot be considered by this Court.
4. Consequently, W.P.No.14890 of 2025 is dismissed.
5. In view of the order passed herein-above, the connected W.P.No.14951 of 2025 filed for a direction to the 1st Respondent to redraw the selection list of candidate based on maximum qualification to be fixed by this Court is also dismissed.
