ORDER

The present revision petition has been filed by the petitioner/3rd defendant challenging the order dated 05.03.2024 passed in I.A.No.5 of 2023 in I.A.No.4 of 2023 in O.S.No.515 of 2014 on the file of the learned District Munsif, Chengalpattu.

2. I have heard the learned counsel on either side and I have also perused the materials placed on record, particularly, the impugned order passed by the learned District Munsif, Chengalpattu.

3. It is seen that the trial Court had dismissed I.A.No.5 of 2023 taken out by the 3rd defendant seeking to produce additional documents in I.A.No.4 of 2023, which has been filed for rejection of the plaint. The trial Court has rightly found that in an application for rejection of plaint, Page No.2 of 5

the 3rd defendant cannot rely on documents and held that it is not necessary to grant leave to the 3rd defendant to file additional documents in I.A.No.4 of 2023 and thereby, dismissed the application in I.A.No.5 of 2023, vide impugned order dated 05.03.2024.

4. I do not find any illegality or infirmity in the findings rendered by the trial court while dismissing the application filed seeking to receive additional documents in I.A.No.5 of 2023 and therefore, I am not inclined to interfere with the same.

5. However, subject to the order being passed in the application filed seeking rejection of plaint in I.A.No.4 of 2023, there being necessity to proceed with the trial of the suit, liberty is granted to the petitioner/3rd defendant to seek permission for production of the additional documents in the suit.

6. Accordingly, this Civil Revision Petition stands dismissed with the aforestated liberty. No costs. Consequently, the connected miscellaneous petition is closed.
