ORDER

The writ petition has been filed directing the 4th respondents to provide police protection for the properties comprised in survey No.149/2A1 to an extent of 1.16 acre and survey No.147 to an extent to 0.60 cents situate at Mookandapally village, Hosur Taluk, Krishnagiri District based on the petitioner representation dated 28.4.2023 forthwith.

2. It is the contention of the learned counsel for the petitioner that a private party is causing disturbance when the petitioner tries to demolish the property derived by way of settlement.

On perusal of the case files and also the submissions of the learned counsel for the petitioner, it would indicate that petitioner and siblings has filed a suit in O.S.No.45 of 2018 for various relief on the file of the District Munsif, Hosur and the petitioner's father has also filed a suit in O.S.No.356 of 2006 on the file of the learned District Munsif, Hosur and they are

pending between the parties.

4.In such view of the matter, a blanket order for police protection cannot be granted. In this regard, the Hon'ble Apex Court in the judgment of P.R.Muralidharan and others Vs. Swami Dharmananda Theertha Padar and others reported in (2006) 4 SCC 501 has held that what are all the matters for which police protection can be granted. For better appreciation, the relevant portion of the judgment is extracted below: "...19. A writ for "police protection" so-called, has only a limited scope, as, when the court is approached for protection of rights declared by a decree or by an order passed by a civil court. It cannot be extended to cases where rights have not been determined either finally by the civil court or, at least at an interlocutory stage in an unambiguous manner, and then too in furtherance of the decree or order."
