ORDER

This writ petition has been filed challenging the impugned letter of the 4 th respondent dated 20.03.2023, wherein the petitioner was directed to pay the entire amount due and payable, failing which the allotment will be cancelled.

2. When this writ petition was entertained, no interim order was passed and hence the Housing Board has proceeded further to cancel the allotment.

3. Learned Standing Counsel for the Housing Board submitted that eventhough the allotment has been cancelled and a decision has been taken that the petitioner is liable to pay arrears, it has not been recovered till date.

4. In the considered view of this Court, the relief as sought in the present writ petition does not survive, since the allotment has been cancelled and possession has been taken. If any arrears are to be recovered from the petitioner,

it is left open to the respondents to recover the same in the manner known to law.

5. In view of the above, the writ petition is dismissed. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. 18-06-2025 gd Index:Yes/No Speaking/Non-speaking order Internet:Yes
