O R D E R

The prayer sought for in this writ petition is for a writ of Declaration, declaring the entire M.B.B.S. Admissions Selection process of the third respondent, for the Academic year 2003-2004 as null and void and consequently, direct the respondents to make fresh selection in the course in accordance with law.

2. When the case is called today, no one was appearing for the petitioner. Further, Mr.M.Elumalai, learned Government Advocate has appeared for the first respondent.

3. Since the writ petition is of the year 2003 and has been pending for 14 years before this court, I am inclined to dispose of this writ petition on merits based on the available records.

4. Since the prayer relates to admission for the M.B.B.S. Course for the academic year 2003-2004 and it was sought to be declared as null and void and consequently sought for a fresh selection, the said prayer cannot be entertained at this stage since the academic year 2003-2004 was over long back and that the petitioner would have admitted in any other/such course and by this time would have come out successfully. 5.In view of the same, the prayer made in the writ petition become infructuous and therefore, no further adjudication is required in this writ petition. Hence, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
