This Court has condoned the delay vide C.M.P. No.10406 of 2012 in filing the petition to set aside the abatement caused by the death of Syed Ahamed S/o. Amir Batch, who is the sole appellant in S.A. No.1068 of 2.

Accordingly, this Civil Miscellaneous Petition filed to set aside the abatement caused due to death of the sole appellant is allowed.
