Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus, directing the first respondent to pass appropriate orders to effect patta transfer in respect of the property measuring to an extent of 1.50 acres comprised in Survey Nos. 1008/1A, 1008/1B and 1008/2 situate at Mornappalli Village, Hosur Taluk, Krishnagiri District, within the stipulated time, based on the representation of the petitioner on 21.11.2012 and the enquiry dated 30.09.2015. Mr.S.N.Parthasarathy, learned Government Advocate, takes notice for the respondents . By consent, the main writ petition itself is taken up for disposal at the admission
stage itself.
2. The petitioner has filed the above writ petition to issue a Writ of Mandamus, directing the first respondent to pass appropriate orders to effect patta transfer in respect of the property measuring an extent of 1.50 acres comprised in Survey Nos.1008/1A, 1008/1B and 1008/2 situated at Mornappalli Village, Hosur Taluk, Krishnagiri District, within a time frame, based on his representation dated 21.11.2012 and the enquiry dated 30.09.2015.
3. The learned counsel appearing for the petitioner submitted that the petitioner has given a representation dated 21.11.2012 for effecting patta transfer in respect of his land and an enquiry was also conducted by the 1st respondent on 30.09.2015. However, no final order has been passed by the 1st respondent till today.
4. Mr.S.N.Parthasarathy learned Government Advocate appearing for the respondents submitted that the 1st respondent may be directed to consider and pass orders on the petitioner's representation dated 21.11.2012, in accordance with law, after giving notice to all the interested parties.
5. In view of the submissions made by the learned counsel on either side, without expressing any opinion with regard to the merits of the case, I direct the 1st respondent to consider the petitioner's representation dated 21.11.2012 and pass orders, in accordance with law, after giving notice to tall the interested parties, within a period of twelve weeks from the date of receipt of a copy of this order.
With this observation, the writ petition is disposed of. No costs.
