in S.A.No.Sr114760 of 2018 P.T.ASHA, J., The above petition is filed to condone the delay of 1246 days in representing the papers. The petitioners would submit that originally they had engaged the service of Mr.V.R.Annagandhi and thereafter since the said counsel stated that he was not willing to continue with the case, she has taken a change of vakalat and handed over the bundle to the counsel who is on record. While handing over the case bundle, all the papers were not handed over to them. Therefore, by the time the present counsel would trace and reconstruct the entire bundle, the delay had occurred.

2. A perusal of the records would show that the appeal has been filed with the delay of 118 days. However, taking into consideration 1/3

the fact that the appeal arises against the order in a suit for declaration and for cancellation of gift deed made in favour of the 2nd appellant, the delay is condoned.
