ORDER

This petition has been filed to relax the condition in para No.9(b) imposed on the petitioner/ A34 in Crl.O.P.No.7194 of 2025, dated 02.04.2025, that the petitioner shall report before the respondent police daily at 10:30 a.m., until further orders.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner has been complying with the condition regularly, however he opposed the relaxation petition of the petitioner by stating that the petitioner along with other accused have cheated the amount to the tune of Rs.2522.63 crores collected from around 1,09,255 depositors and further investigation is in process.

The learned counsel appearing for the petitioner submitted that the conditions imposed on the similarly placed co-accused were modified by this Court vide order dated 07.03.2025 in Crl.M.P.Nos.4161 and 4164 of 2025 in Crl.O.P.No.31368 of 2024 and vide order dated 25.04.2025 in Crl.M.P.No.8211 of 2025 in Crl.O.P.No.30764 of 2024. He also undertakes that the petitioner will co-operate for the further investigation, therefore prays for allowing this relaxation petition.

Considering the submissions of both sides and the nature of offence, the fact that the conditions imposed on the similarly placed coaccused were modified, this Court is of the view that the condition in para No.9(b) imposed on the petitioner in Crl.O.P.No.7194 of 2025, dated 02.04.2025 is relaxed to the effect that the petitioner shall report before 2/4

the respondent police as and when required for interrogation and also to appear before the trial Court on all hearing dates, without fail.
