ORDER

The present writ petition is filed praying for a writ of Mandamus to direct the third respondent, its men, agents or contractors to refrain from constructing any junction or access road at KM 128/460 of NH 45 A to connect or lay road through lands comprised in S.No.236/2B and 236/1, situated at Kathiripu Village, Sirkazhi

2. At the outset, Mr.SR.Sumathy, learned Standing Counsel submitted a status report of the third respondent before this Court. The relevant portion is extracted hereunder:

I am to state that the Independent Engineer has inspected the subject area and in this regard after inspection it is identified in the Project design itself there is no road to provided junction at the subject area. The Independent Engineer has informed in his report that there is no cross road at present at the subject location. There is only a private access road to their land and it is already in existence and put to usage. 2/5

5. I humbly submit that NHAI has alloted the Project work in favour Welspun Sattanathapuram Nagapattinam Road Pvt.Ltd who is the concessionaire. NHAI has informed the concessionaire to not to do any junction works in the subject location as it is not set out in the road plan and design"
