Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing respondents 1 to 4 to consider the representation dated 27.02.2023 and 09.05.2023 made by the petitioner herein to conduct enquiry in respect of irregularities taken place in encroaching water bodies, namely Panaiyur Lake situated in S.No.30, Panaiyur Village, Olakkur Block, Tindivanam Taluk, Villupuram District and other irregularities in the Olakkur Block by misuse of office by the 8th respondent herein and pass appropriate orders within stipulated time period as may be fixed by this Hon'ble Court.

ORDER

(Made by the Hon'ble Chief Justice) We have heard Mr.T.Sundaravadanam, learned counsel for the petitioner and Mrs.R.Anitha, learned Special Government Pleader for the respondents 1 to 4.

2. The petitioner seeks a direction to conduct an enquiry in respect of encroachments on the waterbodies.

3. A counter-affidavit is filed by the third respondent. It is stated that enquiry on the representations of the petitioner by the Assistant Director (Audit) is in progress and the enquiry report is awaited from him. Appropriate action would be taken based on the enquiry report.

4. It is expected that the enquiry be concluded expeditiously, preferably within nine months. Depending upon the report, further steps be undertaken.

5. The writ petition is disposed of. There will be no order as to costs. Consequently, W.M.P.No.15218 of 2023 is closed. (S.V.G., CJ.) (D.B.C., J.) 20.12.2023 Index :
