PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the third respondent to consider and dispose of petitioner's representation dated 07.05.2024 and consequently direct the third respondent to change petitioner name in the patta pursuant to the registered will bearing Document No.03/1995 dated 21.01.1995.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. The writ petitioner seeks for issuance of a writ of mandamus, directing the third respondent to consider and dispose of petitioner's representation dated 07.05.2024 and consequently, direct the third respondent to change the petitioner's name in the patta pursuant to the registered will bearing Document No.03/1995 dated 21.01.1995.

3. The petitioner states that the property which is situated in survey No.19/31A at Uthangarai Village, Dharmapuri District, belongs to her father late Malik Basha. According to the petitioner, her father had 2/4

executed a Will in her favour on 21.01.1995. Under the Will, the petitioner as well as her brothers are beneficiaries. Her father passed away on 12.04.2006. On the strength of the Will, she gave an application to the Thasildar, Uthangarai Taluk, for transfer of patta in her favour. However, an order was passed on 29.07.2006 in favour of one Samyun. Aggrieved by the same, the petitioner has given a representation to the Thasildar. Since no response is forthcoming, she has filed the present writ petition.

4. Mr.G.Krishnaraja, learned Additional Government Pleader, took notice for the respondents. He would submit that the petitioner's representation dated 07.05.2024 will be disposed of within a period of twelve (12) weeks after issuing notice to the petitioner as well as any other persons, who are interested in the property.

5. The said submission is recorded. The third respondent is directed to dispose of the petitioner's representation dated 07.05.2024 within a period of twelve (12) weeks from the date of receipt of a copy of this order.
